If the beer and wine license request can’t fit the code, perhaps the code can be adjusted to fit the request.
Back in June, family-owned movie theater chain Fox Theatres requested a hearing before the Board of License Commissioners — the county board responsible for issuing and enforcing liquor licenses and their orbiting legislation — seeking a Class B license for the uptown location.
Presumably, this is part of the recent $1.5 million rehabilitation project for the theater, which included a number of amenities such as reclining seats and retractable armrests.
The problem is a Class B license doesn’t really cover movie theaters — it’s usually used for restaurants.
